Abdullah bin Sahl, of the Ansar, was found killed in one of the wells of Khaybar. His two paternal uncles and his brother came to the Messenger of Allah ﷺ. His brother was Abdul-Rahman bin Sahl, and his two uncles were Huwaysa and Muhaysa.Abdul-Rahman started to speak before the Messenger of Allah ﷺ, but the Messenger said, "Let the elder speak, the elder."So one of his two uncles spoke, either Huwaysa or Muhaysa. Sufyan said, "I have forgotten which of the two was the elder."He said, "Messenger of Allah, we found Abdullah killed in one of the wells of Khaybar." He then mentioned the Jews, their evil, and their enmity.The Messenger said, "Fifty of you must swear an oath that the Jews killed him."They replied, "How can we swear to something we did not witness?"He said, "Then the Jews can clear themselves by fifty oaths, swearing that they did not kill him."They said, "How can we accept their oaths when they are polytheists?"So the Messenger of Allah ﷺ paid the blood-money for him from his own resources.Sahl said, "A young she-camel from those camels kicked me."Sufyan was asked about the wording in the hadith, "And you become entitled to the blood of your companion." He said, "That is in it."
قال أخبرنا سفيان عن يحيى بن سعيد سمع بشير بن يسار مولى بني حارثة قال سفيان هذا حديث ابن حثمة يخبر
ووجد عبد الله بن سهل من الأنصار قتيلا في قليب من قلب خيبر فجاء عماه وأخوه إلى رسول الله ﷺ أخوه عبد الرحمن بن سهل وعماه حويصة ومحيصة فذهب عبد الرحمن يتكلم عند رسول الله ﷺ فقال الكبر الكبر فتكلم أحد عميه إما حويصة وإما محيصة قال سفيان نسيت أيهما الكبير منهما فقال يا رسول الله إنا وجدنا عبد الله قتيلا في قليب من قلب خيبر ثم ذكر يهود وشرهم وعداوتهم قال ليقسم منكم خمسون أن يهود قتلته قالوا كيف نقسم على ما لم نر قال فتبرئكم يهود بخمسين يحلفون أنهم لم يقتلوه قالوا كيف نرضى بأيمانهم وهم مشركون قال فوداه رسول الله ﷺ من عنده فركضتني بكرة منه قيل لسفيان في الحديث وتستحقون دم صاحبكم قال هو ذا
Its isnad is sahih, and Bashir bin Yasar is trustworthy and a jurist as well. Bukhari narrated the hadith, 6/275, no. 3173, Fath al-Bari, in the chapter on jizya, on treaties, and Muslim, 3/1291, no. 1669, in the chapter on qasamah, and Abu Dawud, 4/178, no. 4521, and Tirmidhi, 4/30, no. 1422, and Nasai, 8/7, in the chapter on qasamah, mention of qasamah, and Ibn Majah, 2/892, no. 2677.
