Whenever one of us had no need for his land, or was unable to work it himself, he would lease it out for a half, a third, or a quarter of the produce, stipulating for himself three irrigation channels, what remained on the threshing floor, and whatever was watered by the spring streams. We used to labor hard on such land and gain some benefit from it.Then Rafi bin Khadij came to us and said, "The Messenger of Allah ﷺ has forbidden a practice that was profitable for you, but obedience to Allah and obedience to His Messenger ﷺ is better for you. He has forbidden you from leasing fields for a share of the crop."He also said, "Whoever has land, let him give it to his brother to cultivate, or else leave it fallow."He further told us that the Messenger of Allah ﷺ forbade muzabanah. Muzabanah is when a man owns a large quantity of dates on the palm trees, and another man comes and buys them in exchange for such-and-such a number of wasqs of harvested dates.
حدثنا محمد بن جعفر قال حدثنا شعبة عن منصور قال سمعت مجاهدا يحدث
كان أحدنا إذا استغنى عن أرضه أو افتقر إليها أعطاها بالنصف والثلث والربع ويشترط ثلاث جداول والقصارة وما سقى الربيع وكنا نعمل فيها عملا شديدا ونصيب منها منفعة فأتانا رافع بن خديج فقال نهى رسول الله ﷺ عن أمر كان لكم نافعا وطاعة الله وطاعة رسول الله ﷺ خير لكم نهاكم عن الحقل وقال من كانت له أرض فليمنحها أخاه أو ليدعها ونهانا عن المزابنة والمزابنة الرجل يكون له المال العظيم من النخل فيجيء الرجل فيأخذها بكذا وكذا وسقا من تمر
