I would not carry out a prescribed punishment on a man and have him die from it, then feel any unease within myself about it, except in the case of one punished for drinking wine. If such a man died, I would pay his blood-money.Sufyan added, "That is because the Messenger of Allah ﷺ did not establish a fixed penalty for it."
حدثنا وكيع حدثنا مسعر وسفيان عن أبي حصين عن عمير بن سعيد قال
ما كنت لأقيم على رجل حدا فيموت فأجد في نفسي منه إلا صاحب الخمر فلو مات وديته وزاد سفيان وذلك أن رسول الله ﷺ لم يسنه
Its isnad is sahih, and it is a repetition of 1024. In ح there is an addition of the word "qul" before his statement, "he did not make it a sunnah," which is an addition with no meaning, and it is not found in ك and هـ, so we removed it.
