Numan bin Bashir reported,
He held them for several days, then released them. The men went to Numan and said, "You released them without beating or interrogating them."Numan replied, "It is up to you. If you wish, I will flog them. If your goods are produced, well and good. Otherwise, I will take from your backs the same as I take from theirs."They said, "Is this your judgment?"He answered, "This is the judgment of Allah and the judgment of His Messenger ﷺ."

Daifحدثنا عبد الوهاب بن نجدة حدثنا بقية حدثنا صفوان حدثنا أزهر بن عبد الله الحرازي أن قوما من الكلاعيين سرق لهم متاع فاتهموا أناسا من الحاكة فأتوا
النعمان بن بشير صاحب النبي ﷺ
فحبسهم أياما ثم خلى سبيلهم فأتوا النعمان فقالوا خليت سبيلهم بغير ضرب ولا امتحان فقال النعمان ما شئتم إن شئتم أن أضربهم فإن خرج متاعكم فذاك وإلا أخذت من ظهوركم مثل ما أخذت من ظهورهم فقالوا هذا حكمك فقال هذا حكم الله وحكم رسوله ﷺ
Referencing, its chain is daif. Nasai narrated it in the Book on Cutting Off the Thief's Hand, in the section on testing the thief through beating and imprisonment, hadith no. 4878, from the hadith of Baqiya bin Walid with this same wording, and he said, "This is a rejected hadith, it cannot be relied upon. I have only included it so that it would be recognized as such."Azhar bin Abdullah, there is doubt regarding his having actually heard from Numan bin Bashir 
, but the rest of the chain is hasan.
