Two men came to the Messenger of Allah ﷺ disputing over an inheritance they shared, and neither of them had any evidence beyond his own claim. The Prophet ﷺ said, "I am only a human being, and you bring your disputes to me. Perhaps one of you is more eloquent in presenting his case than the other, so I rule in his favor according to what I hear from him. Whoever I award something that belongs by right to his brother, let him take nothing of it, for I am only cutting out for him a piece of the Fire."At this both men wept, and each one said, "My share is yours."The Prophet ﷺ said to them, "Since you have both done what you have done, then divide the inheritance, aim for what is right, then draw lots, and then let each of you release the other from any claim."
حدثنا الربيع بن نافع أبو توبة حدثنا ابن المبارك عن أسامة بن زيد عن عبد الله بن رافع مولى أم سلمة عن أم سلمة قالت أتى رسول الله ﷺ رجلان يختصمان في مواريث لهما لم تكن لهما بينة إلا دعواهما فقال النبي ﷺ فذكر مثله فبكى الرجلان وقال كل واحد منهما حقي لك فقال لهما النبي ﷺ أما إذ فعلتما ما فعلتما فاقتسما وتوخيا الحق ثم استهما ثم تحالا
Graded as, its chain of transmission is hasan. Ahmad narrated it, 6/320, from the hadith of Usama bin Zayd, and he is hasan al-hadith (previously mentioned, 347). Ibn Mulaqqin graded it sahih in Tuhfat al-Muhtaj, hadith 1778, as did Ibn Jarud, hadith 1000, and Hakim, on the condition of Muslim, 4/95, and Dhahabi agreed with him.
