The Messenger of Allah ﷺ said, "If any man becomes bankrupt and another man finds his own goods with him intact, he has a greater right to them than anyone else."
حدثنا عبد الله بن مسلمة عن مالك ح و حدثنا النفيلي حدثنا زهير المعنى عن يحيى بن سعيد عن أبي بكر بن محمد بن عمرو بن حزم عن عمر بن عبد العزيز عن أبي بكر بن عبد الرحمن
أن رسول الله ﷺ قال أيما رجل أفلس فأدرك الرجل متاعه بعينه فهو أحق به من غيره
Bukhari narrated it in Kitab al-Istiqrad, chapter "If someone finds his property with a bankrupt person after a sale," etc., hadith no. 2402, and Muslim narrated it in Kitab al-Musaqat, chapter "Whoever finds what he sold with the buyer who has then gone bankrupt has the right to reclaim it," hadith no. 1559 (Indian edition: 2/17), from the hadith of Zuhayr, meaning Ibn Muawiya al-Jufi, Abu Khaythama. The hadith is also in Muwatta (Yahya) 2/678. In some copies of Sahih Muslim it appears as Zuhayr bin Harb, but this is an error.
