Ashath bought some slaves from the fifth share of war booty from Abdullah for twenty thousand. Abdullah sent to him asking for their price, but Ashath said, "I only took them for ten thousand."Abdullah said, "Then choose a man to arbitrate between you and me."Ashath replied, "You yourself can be the judge between me and you."Abdullah said, "I heard the Messenger of Allah ﷺ say, 'When the buyer and seller disagree and there is no evidence between them, then the word is that of the owner of the goods, or they cancel the transaction.'"

اشترى الأشعث رقيقا من رقيق الخمس من عبد الله بعشرين ألفا فأرسل عبد الله إليه في ثمنهم فقال إنما أخذتهم بعشرة آلاف فقال عبد الله فاختر رجلا يكون بيني وبينك قال الأشعث أنت بيني وبين نفسك قال عبد الله فإني سمعت رسول الله ﷺ يقول إذا اختلف البيعان وليس بينهما بينة فهو ما يقول رب السلعة أو يتتاركان
[Hasan] Nasai transmitted it in the Book of Business Transactions, Chapter on the two parties to a transaction disputing over the price, no. 4652, from the hadith of Umar bin Hafs bin Ghiyath through this chain. Ibn Jarud graded it sahih, no. 625, as did Hakim, 2/45, and Dhahabi agreed with him, but its chain is daif. The hadith has corroborating narrations in Ibn Jarud, no. 624, and elsewhere.
