The Messenger of Allah ﷺ permitted the sale of unripe dates on the tree (araya) in quantities less than five wasqs, or in five wasqs. Dawud bin Husayn was uncertain which.
Bukhari narrated it in the Book of Musaqah, chapter "A Man Who Has a Right of Passage or a Water Share in a Garden or Palm Grove," no. 2382, and Muslim in the Book of Business Transactions, chapter "The Prohibition of Selling Fresh Dates for Dried Dates Except in the Case of Araya," no. 1541, from the hadith of Malik through this same chain, and it is found in Muwatta (Yahya): 2/620.
