Hisham explained that unjust encroachment means a man planting in someone else's land and thereby claiming a right to it. Malik said that unjust encroachment covers anything taken, dug up, or planted without right.

Takhrij, its isnad is sahih. Ibn Abdul-Barr transmitted it in Tamhid 22/284 from the hadith of Abu Dawud through this route, and it is found in Muwatta (Yahya) 2/743.
