Abyaz bin Hamal asked the Messenger of Allah ﷺ about restricting arak trees as private reserves.The Messenger of Allah ﷺ said, "There is no reserving of arak trees."He said, "But it is an arak tree within my enclosure."The Prophet ﷺ replied, "There is no reserving of arak trees."Faraj said, by "my enclosure" he meant the cultivated land surrounded by walls.

أبيض بن حمال أنه سأل رسول الله ﷺ عن حمى الأراك فقال رسول الله ﷺ لا حمى في الأراك فقال أراكة في حظاري فقال النبي ﷺ لا حمى في الأراك قال فرج يعني بحظاري الأرض التي فيها الزرع المحاط عليها
Sourcing, its isnad is daif. See number 3028. Darimi also narrated it, number 2614, from Abdullah bin Zubayr Humaydi, with the same chain, and its basic version is found in Ibn Majah, number 2475. Thabit and his father are both obscure, no one other than Ibn Hibban has vouched for their reliability.
