Abbas and Ali came in to see Umar while Talha, Zubayr, Abdul-Rahman, and Saad were with him, and the two of them were disputing with each other.Umar said to Talha, Zubayr, Abdul-Rahman, and Saad, "Do you not know that the Messenger of Allah ﷺ said, 'All of the Prophet's property is charity, except what he feeds his family and clothes them with. We do not leave inheritance.'?"They replied, "Yes, indeed."Umar continued, "So the Messenger of Allah ﷺ used to spend from this property on his family and give the surplus in charity. Then the Messenger of Allah ﷺ passed away, and Abu Bakr took charge of it for two years, doing with it exactly what the Messenger of Allah ﷺ had done."Then he mentioned part of the hadith of Malik bin Aws.
حدثنا عمرو بن مرزوق أخبرنا شعبة عن عمرو بن مرة عن أبي البختري قال سمعت
دخل العباس وعلي على عمر وعنده طلحة والزبير وعبد الرحمن وسعد وهما يختصمان فقال عمر لطلحة والزبير وعبد الرحمن وسعد ألم تعلموا أن رسول الله ﷺ قال كل مال النبي صدقة إلا ما أطعمه أهله وكساهم إنا لا نورث قالوا بلى قال فكان رسول الله ﷺ ينفق من ماله على أهله ويتصدق بفضله ثم توفي رسول الله ﷺ فوليها أبو بكر سنتين فكان يصنع الذي كان يصنع رسول الله ﷺ ثم ذكر شيئا من حديث مالك بن أوس
[Its chain is daif] Bayhaqi narrated it, 6/299, 300, from the hadith of Abu Dawud through this route. It contains an unknown narrator, and hadith 2963 serves in its place.
