The Prophet ﷺ said, "There is no divorce except in what you own, no emancipation except in what you own, and no sale except in what you own."Ibn al-Sabbah added, "And no fulfillment of a vow except in what you own."
حدثنا مسلم بن إبراهيم حدثنا هشام ح و حدثنا ابن الصباح حدثنا عبد العزيز بن عبد الصمد قالا
أن النبي ﷺ قال لا طلاق إلا فيما تملك ولا عتق إلا فيما تملك ولا بيع إلا فيما تملك زاد ابن الصباح ولا وفاء نذر إلا فيما تملك
[Its isnad is hasan] Reported by Nasai in the Book of Business Transactions, chapter on selling what the seller does not possess, no. 4616, from the hadith of Matar Warraq with this chain. Ibn Majah also narrated it, no. 2047, as did Tirmidhi, no. 1181, who said, hasan sahih. Ibn Mulaqqin graded it sahih in Tuhfat al-Muhtaj, no. 1184, as did Dhahabi in Talkhis Mustadrak, 2/204, 205.
