The Messenger of Allah ﷺ said, "A previously married woman has more right over herself than her guardian, and a virgin is to be consulted regarding herself, and her silence is her consent."This is the wording of al-Qanabi.
حدثنا أحمد بن يونس وعبد الله بن مسلمة قالا أخبرنا مالك عن عبد الله بن الفضل عن نافع بن جبير
قال رسول الله ﷺ الأيم أحق بنفسها من وليها والبكر تستأذن في نفسها وإذنها صماتها وهذا لفظ القعنبي
Muslim narrated it in the Book of Marriage, Chapter on Seeking the Consent of the Previously Married Woman for Marriage by Speech and the Virgin by Silence, hadith no. 1421, from the hadith of Malik through this same chain, and it is found in Muwatta (Yahya) 2/524.
