Abdullah bin Amr bin As reported,

It was reported from the Messenger of Allah ﷺ that he was asked about hanging fruit. He said, "Whoever takes some in his mouth out of need, without carrying any away in his garment, is not liable. But whoever carries any of it away owes a fine of twice its value as well as punishment. And whoever steals any of it after it has been placed in the drying enclosure, if it reaches the value of a shield, his hand is to be cut off."He mentioned regarding stray camels and sheep what others have mentioned.He said, He was asked about lost property and said, "Whatever is found on a frequented road or in an inhabited town, announce it for a year. If its claimant comes, hand it over to him. If no one comes, it is yours. As for what is found in ruins," meaning, "in it and in buried treasure, a fifth is due."

حدثنا قتيبة بن سعيد حدثنا الليث عن ابن عجلان

عن عمرو بن شعيب عن أبيه عن جده عبد الله بن عمرو بن العاص

عن رسول الله ﷺ أنه سئل عن الثمر المعلق فقال من أصاب بفيه من ذي حاجة غير متخذ خبنة فلا شيء عليه ومن خرج بشيء منه فعليه غرامة مثليه والعقوبة ومن سرق منه شيئا بعد أن يؤويه الجرين فبلغ ثمن المجن فعليه القطع وذكر في ضالة الإبل والغنم كما ذكره غيره قال وسئل عن اللقطة فقال ما كان منها في طريق الميتاء أو القرية الجامعة فعرفها سنة فإن جاء طالبها فادفعها إليه وإن لم يأت فهي لك وما كان في الخراب يعني ففيها وفي الركاز الخمس
