Nafi bin Alqama appointed Ubayy as the chief of his tribe and instructed him to collect their charity. Ubayy sent me out to collect from a group of them, so I came to a very old man named Saar bin Daysam and said to him, "My father has sent me to you to collect your charity."He said, "Nephew, which type do you take?"I replied, "We make a selection, even examining the udders of the sheep."He said, "Nephew, let me tell you something. I was in one of these mountain passes during the time of the Messenger of Allah ﷺ, tending some sheep of mine, when two men came to me on a camel. They said, 'We are the messengers of the Messenger of Allah ﷺ, sent to you so you may pay the charity due on your sheep.'I asked, 'What is due from me on them?'They replied, 'One sheep.'So I went to a sheep whose location I knew well, full of milk and fat, and brought it out to them. They said, 'This is a pregnant sheep, and the Messenger of Allah ﷺ has forbidden us from taking a pregnant one.'I said, 'Then what will you take?'They said, 'A young she-goat in its second or third year.'So I went to a muta'tat young she-goat, the muta'tat being one that has not yet given birth but whose time of delivery is near, and brought her out to them. They said, 'Hand her to us.' So they placed her with them on their camel and went on their way."
حدثنا الحسن بن علي حدثنا وكيع عن زكريا بن إسحق المكي عن عمرو بن أبي سفيان الجمحي عن مسلم بن ثفنة اليشكري قال الحسن روح يقول
استعمل نافع بن علقمة أبي على عرافة قومه فأمره أن يصدقهم قال فبعثني أبي في طائفة منهم فأتيت شيخا كبيرا يقال له سعر بن ديسم فقلت إن أبي بعثني إليك يعني لأصدقك قال ابن أخي وأي نحو تأخذون قلت نختار حتى إنا نتبين ضروع الغنم قال ابن أخي فإني أحدثك أني كنت في شعب من هذه الشعاب على عهد رسول الله ﷺ في غنم لي فجاءني رجلان على بعير فقالا لي إنا رسولا رسول الله ﷺ إليك لتؤدي صدقة غنمك فقلت ما علي فيها فقالا شاة فأعمد إلى شاة قد عرفت مكانها ممتلئة محضا وشحما فأخرجتها إليهما فقالا هذه شاة الشافع وقد نهانا رسول الله ﷺ أن نأخذ شافعا قلت فأي شيء تأخذان قالا عناقا جذعة أو ثنية قال فأعمد إلى عناق معتاط والمعتاط التي لم تلد ولدا وقد حان ولادها فأخرجتها إليهما فقالا ناولناها فجعلاها معهما على بعيرهما ثم انطلقا
[Its chain of transmission is daif] Reported by Nasai, Zakat, chapter of the owner giving the wealth without the tax collector's choice, no. 2464, from the hadith of Waki, through this route. Muslim bin Thafanah was deemed reliable by Ibn Hibban alone, so he is of unknown status.
