Abdullah bin Uthman, the companion of Shuba, said to him, "Had it been anyone other than Hakeem who narrated this hadith..."Sufyan said to him, "What is wrong with Hakeem that Shuba does not narrate from him?"He replied, "Yes."Sufyan said, "I heard Zubayd narrate this from Muhammad bin Abdul-Rahman bin Yazid."This is what some of our companions act upon, and it is the view of al-Thawri, Abdullah bin Mubarak, Ahmad, and Ishaq. They said that when a man possesses fifty dirhams, charity is not lawful for him.He said, some of the people of knowledge did not go by the hadith of Hakeem bin Jubayr and were more lenient on this matter. They said that if a man has fifty dirhams or more but is in need, he may take from the zakat. This is the view of al-Shafii and others among the people of jurisprudence and knowledge.

فقال له عبد الله بن عثمان صاحب شعبة لو غير حكيم حدث بهذا الحديث فقال له سفيان وما لحكيم لا يحدث عنه شعبة قال نعم قال سفيان سمعت زبيدا يحدث بهذا عن محمد بن عبد الرحمن بن يزيد والعمل على هذا عند بعض أصحابنا وبه يقول الثوري وعبد الله بن المبارك وأحمد وإسحق قالوا إذا كان عند الرجل خمسون درهما لم تحل له الصدقة قال ولم يذهب بعض أهل العلم إلى حديث حكيم بن جبير ووسعوا في هذا وقالوا إذا كان عنده خمسون درهما أو أكثر وهو محتاج فله أن يأخذ من الزكاة وهو قول الشافعي وغيره من أهل الفقه والعلم
