The Messenger of Allah ﷺ said, "The maternal uncle is the heir of one who has no heir."This is a hasan gharib hadith. Some narrators transmitted it as mursal and did not mention Ayesha in the chain.The companions of the Prophet ﷺ differed on this matter. Some of them granted inheritance to the maternal uncle, the maternal aunt, and the paternal aunt. Most scholars adopted this hadith regarding the inheritance of distant relatives. Zayd bin Thabit, however, did not grant them inheritance and instead assigned such estates to the public treasury.
أخبرنا إسحق بن منصور أخبرنا أبو عاصم عن ابن جريج عن عمرو بن مسلم عن طاووس
قال رسول الله ﷺ الخال وارث من لا وارث له وهذا حديث حسن غريب وقد أرسله بعضهم ولم يذكر فيه عن عائشة واختلف فيه أصحاب النبي ﷺ فورث بعضهم الخال والخالة والعمة وإلى هذا الحديث ذهب أكثر أهل العلم في توريث ذوي الأرحام وأما زيد بن ثابت فلم يورثهم وجعل الميراث في بيت المال

[Hasan] Nasai also narrated it in al-Kubra, no. 6352, from the hadith of Ibn Jurayj through the same route, and he found fault with it, and its chain is daif, but the preceding hadith serves as a corroborating witness for it.
