A man from Mazina came to the Messenger of Allah ﷺ and asked, "Messenger of Allah, what is your view concerning livestock taken from the mountain pastures?"He replied, "The thief must pay back its value twice over along with a punishment. There is no amputation for stealing livestock unless it is taken from the enclosure where it is kept. If what is stolen reaches the value of a shield, the hand is cut off. If it does not reach the value of a shield, there is a fine of twice its value and lashes as a deterrent."The man asked, "Messenger of Allah, what is your view concerning fruit still hanging on the tree?"He replied, "The thief must pay back its value twice over along with a punishment. There is no amputation for stealing hanging fruit unless it is taken from the drying area. If what is taken from the drying area reaches the value of a shield, amputation applies. If it does not reach the value of a shield, there is a fine of twice its value and lashes as a deterrent."
قال الحارث بن مسكين قراءة عليه وأنا أسمع عن ابن وهب قال أخبرني عمرو بن الحارث وهشام بن سعد عن عمرو بن شعيب عن أبيه
أن رجلا من مزينة أتى رسول الله ﷺ فقال يا رسول الله كيف ترى في حريسة الجبل فقال هي ومثلها والنكال وليس في شيء من الماشية قطع إلا فيما آواه المراح فبلغ ثمن المجن ففيه قطع اليد وما لم يبلغ ثمن المجن ففيه غرامة مثليه وجلدات نكال قال يا رسول الله كيف ترى في الثمر المعلق قال هو ومثله معه والنكال وليس في شيء من الثمر المعلق قطع إلا فيما آواه الجرين فما أخذ من الجرين فبلغ ثمن المجن ففيه القطع وما لم يبلغ ثمن المجن ففيه غرامة مثليه وجلدات نكال
