A woman struck her co-wife with a tent pole and killed her, while the victim was pregnant. The case was brought before the Prophet ﷺ, and the Messenger of Allah ﷺ ruled that the paternal male relatives of the killer must pay the blood-money for the woman, and for the unborn child a slave of fine quality.Her relatives protested, "Should we pay compensation for one who neither ate nor drank, neither cried out nor wailed at birth? The blood of such a one should be disregarded."The Prophet ﷺ replied, "Is this rhymed prose like that of the Bedouins?"
أخبرنا علي بن محمد بن علي قال حدثنا خلف وهو ابن تميم قال حدثنا زائدة عن منصور عن إبراهيم عن عبيد بن نضيلة
أن امرأة ضربت ضرتها بعمود فسطاط فقتلتها وهي حبلى فأتي فيها النبي ﷺ فقضى رسول الله ﷺ على عصبة القاتلة بالدية وفي الجنين غرة فقال عصبتها أدي من لا طعم ولا شرب ولا صاح فاستهل فمثل هذا يطل فقال النبي ﷺ أسجع كسجع الأعراب
Muslim narrated it in the Book of Qasamah, Chapter on the blood money for the fetus and the obligation of blood money in cases of unintentional killing, etc., Hadith: 1682, from the hadith of Mansur, through him. It is also found in Al-Kubra, Hadith: 7025.
