Two women from Huzayl got into a fight, and one of them threw a stone at the other, striking her and killing her along with the child in her womb. The dispute was brought before the Messenger of Allah ﷺ, who ruled that the blood-money for the unborn child was a male or female slave, and that the blood-money for the woman was due from the killer's paternal male relatives. He assigned her inheritance to her children and those with them.Haml bin Malik bin Nabigha al-Huzayli said, "Messenger of Allah, how can I be made to pay for one who did not drink, did not eat, did not speak, and did not even cry out? Such a claim should be dismissed."The Messenger of Allah ﷺ replied, "This man is one of the brothers of the soothsayers," because of the rhymed prose he had spoken.
أخبرنا أحمد بن عمرو بن السرح قال حدثنا عبد الله بن وهب قال أخبرني يونس عن ابن شهاب عن أبي سلمة وسعيد بن المسيب
اقتتلت امرأتان من هذيل فرمت إحداهما الأخرى بحجر وذكر كلمة معناها فقتلتها وما في بطنها فاختصموا إلى رسول الله ﷺ فقضى رسول الله ﷺ أن دية جنينها غرة عبد أو وليدة وقضى بدية المرأة على عاقلتها وورثها ولدها ومن معهم فقال حمل بن مالك بن النابغة الهذلي يا رسول الله كيف أغرم من لا شرب ولا أكل ولا نطق ولا استهل فمثل ذلك يطل فقال رسول الله ﷺ إنما هذا من إخوان الكهان من أجل سجعه الذي سجع
Muslim narrated it in "Qasamah," chapter "The Blood Money for the Fetus, and the Obligation of Blood Money for Unintentional Killing," etc., Hadith 36/1681, from Ahmad bin Amr bin Sarh, and Bukhari in "Diyat," chapter "The Fetus of a Woman, and that Liability Falls on the Father and the Father's Paternal Relatives, Not on the Child," Hadith 6910, from the hadith of Ibn Wahb, through this same chain.
