Ibn Muhaysa the younger was found killed at the gates of Khaybar.The Messenger of Allah ﷺ said, "Bring two witnesses to identify his killer, and I will hand him over to you bound."He said, "Messenger of Allah, how can I find two witnesses when he was simply found killed at their gates?"The Prophet said, "Then take fifty oaths."He replied, "Messenger of Allah, how can I swear to something I do not know?"The Messenger of Allah ﷺ said, "Then we shall require fifty oaths from them."He said, "Messenger of Allah, how can we require oaths from them when they are Jews?"So the Messenger of Allah ﷺ apportioned his blood-money against them and assisted them by paying half of it himself.
أخبرنا محمد بن معمر قال حدثنا روح بن عبادة قال حدثنا عبيد الله بن الأخنس
أن ابن محيصة الأصغر أصبح قتيلا على أبواب خيبر فقال رسول الله ﷺ أقم شاهدين على من قتله أدفعه إليكم برمته قال يا رسول الله ومن أين أصيب شاهدين وإنما أصبح قتيلا على أبوابهم قال فتحلف خمسين قسامة قال يا رسول الله وكيف أحلف على ما لا أعلم فقال رسول الله ﷺ فنستحلف منهم خمسين قسامة فقال يا رسول الله كيف نستحلفهم وهم اليهود فقسم رسول الله ﷺ ديته عليهم وأعانهم بنصفها
