The Messenger of Allah ﷺ said, "Pre-emption applies to every shared property, whether a dwelling or a garden. It is not permissible for one partner to sell his share until he notifies his partner. If he sells without notifying him, the partner has the greater right to it until he is notified."
أخبرنا عمرو بن زرارة قال أنبأنا إسمعيل عن ابن جريج قال أخبرني أبو الزبير
قال رسول الله ﷺ الشفعة في كل شرك ربعة أو حائط لا يصلح له أن يبيع حتى يؤذن شريكه فإن باع فهو أحق به حتى يؤذنه
