Ibn Abbas was asked about a woman who gave birth twenty nights after her husband's death, whether it was permissible for her to remarry.He replied, "No, not until the later of the two terms has passed."I said, "But Allah said, 'And those who are pregnant, their term is until they give birth' [Talaq 65:4]."He responded, "That applies only in the case of divorce."Abu Hurairah then said, "I side with my nephew," meaning Abu Salama. So he sent his servant Kurayb, saying, "Go to Umm Salama and ask her whether this was a practice of the Messenger of Allah ﷺ."He returned and reported that she said, "Yes. Sabia Aslamiyya gave birth twenty nights after her husband's death, and the Messenger of Allah ﷺ instructed her to marry. Abu Sanabil was among those who proposed to her."
أخبرني محمد بن عبد الله بن بزيع قال حدثنا يزيد وهو ابن زريع قال حدثنا حجاج قال حدثنا يحيى بن أبي كثير قال
قيل لابن عباس في امرأة وضعت بعد وفاة زوجها بعشرين ليلة أيصلح لها أن تزوج قال لا إلا آخر الأجلين قال قلت قال الله تبارك وتعالى {وأولات الأحمال أجلهن أن يضعن حملهن} فقال إنما ذلك في الطلاق فقال أبو هريرة أنا مع ابن أخي يعني أبا سلمة فأرسل غلامه كريبا فقال ائت أم سلمة فسلها هل كان هذا سنة من رسول الله ﷺ فجاء فقال قالت نعم سبيعة الأسلمية وضعت بعد وفاة زوجها بعشرين ليلة فأمرها رسول الله ﷺ أن تزوج فكان أبو السنابل فيمن يخطبها
Bukhari narrated it in the Book of Tafsir, chapter "And for those who are pregnant, their term is until they deliver their burden... etc.," hadith no. 4909, from the hadith of Yahya bin Abu Kathir. Muslim narrated it in the Book of Divorce, chapter on the completion of the waiting period of a widow and others by delivering the child, hadith no. 57/1485, from the hadith of Abu Salama through the same chain. It is also in Kubra, hadith no. 5705, and it contains a non-detracting defect.
