The Prophet ﷺ was asked about a man who has relations with his wife's slave Jariya. He said, "If she had given the Jariya to him as permissible, he is given a hundred lashes. If she had not given the Jariya to him as permissible, he is stoned."
أخبرنا محمد بن بشار قال حدثنا محمد قال حدثنا شعبة عن أبي بشر عن خالد بن عرفطة عن حبيب بن سالم
عن النبي ﷺ في الرجل يأتي جارية امرأته قال إن كانت أحلتها له جلدته مائة وإن لم تكن أحلتها له رجمته
[Hasan]. Reported by Abu Dawud, Hudud, chapter on a man who commits zina with his wife's slave girl, no. 4459, from Muhammad bin Bashshar with this wording, and it is also found in Kubra, no. 5551. The hadith has corroborating narrations in Bayhaqi, 8/240, and Ibn Majah, no. 2552, and others.
