Since I parted from the Messenger of Allah ﷺ, no question has weighed on me more heavily than this one. So go and ask someone else.They kept coming back to him about it for a month, and at the end of that period they said to him, "Whom shall we ask if not you? You are among the most senior companions of Muhammad ﷺ in this land, and we can find no one else."He said, "I will give my best judgment on this matter. If it is correct, it is from Allah alone, who has no partner. If it is wrong, it is from me and from Satan, and Allah and His Messenger are free of it. I rule that she is entitled to a dowry equal to that of women like her, neither less nor more, that she inherits, and that she observes a waiting period of four months and ten days."Some men from Ashja were present and heard this. They stood up and said, "We bear witness that you have judged exactly as the Messenger of Allah ﷺ judged in the case of a woman from among us called Birwa bint Washiq."Abdullah was never seen rejoicing on any day as much as he rejoiced then, except for the day he embraced Islam.
أخبرنا علي بن حجر قال حدثنا علي بن مسهر عن داود بن أبي هند عن الشعبي عن علقمة عن عبد الله أنه أتاه قوم فقالوا إن رجلا منا تزوج امرأة ولم يفرض لها صداقا ولم يجمعها إليه حتى مات
ما سئلت منذ فارقت رسول الله ﷺ أشد علي من هذه فأتوا غيري فاختلفوا إليه فيها شهرا ثم قالوا له في آخر ذلك من نسأل إن لم نسألك وأنت من جلة أصحاب محمد ﷺ بهذا البلد ولا نجد غيرك قال سأقول فيها بجهد رأيي فإن كان صوابا فمن الله وحده لا شريك له وإن كان خطأ فمني ومن الشيطان والله ورسوله منه برآء أرى أن أجعل لها صداق نسائها لا وكس ولا شطط ولها الميراث وعليها العدة أربعة أشهر وعشرا قال وذلك بسمع أناس من أشجع فقاموا فقالوا نشهد أنك قضيت بما قضى به رسول الله ﷺ في امرأة منا يقال لها بروع بنت واشق قال فما رئي عبد الله فرح فرحة يومئذ إلا بإسلامه
Its isnad is sahih, and it is found in Kubra, hadith no. 5518. Ibn Hibban graded it sahih, hadith no. 1263, and Hakim ruled it meets the standard of Muslim, 2/101, and Dhahabi agreed with him. The hadith has many corroborating witnesses.
