Saad bin Abu Waqqas reported,

I fell ill, so I sent word to the Prophet ﷺ and said, "Let me distribute my wealth however I wish."He refused.I said, "Then half?"He refused.I said, "Then a third?"He remained silent after the third was mentioned. So from then on, a third was permitted.

و حدثني محمد بن المثنى وابن بشار قالا حدثنا محمد بن جعفر حدثنا شعبة عن سماك بهذا الإسناد نحوه ولم يذكر فكان بعد الثلث جائزا
