A woman in Madinah granted a walled garden of hers to her son for his lifetime. He later died, and she died after him, leaving behind a son. The deceased son also had brothers, who were the sons of the woman who had granted the garden.The son of the original grantor said, "The garden returns to us."The sons of the man to whom it had been granted said, "Rather, it belonged to our father in his life and after his death."They brought their dispute before Tariq, the freed slave of Uthman. He summoned Jabir, who testified that the Messenger of Allah ﷺ had ruled that a lifetime grant belongs to the one to whom it was given. Tariq judged accordingly, then wrote to Abdul-Malik informing him of the matter and of Jabir's testimony.Abdul-Malik replied, "Jabir has spoken the truth."Tariq carried out the ruling, and that garden has belonged to the sons of the man to whom it was granted to this day.

أعمرت امرأة بالمدينة حائطا لها ابنا لها ثم توفي وتوفيت بعده وتركت ولدا وله إخوة بنون للمعمرة فقال ولد المعمرة رجع الحائط إلينا وقال بنو المعمر بل كان لأبينا حياته وموته فاختصموا إلى طارق مولى عثمان فدعا جابرا فشهد على رسول الله ﷺ بالعمرى لصاحبها فقضى بذلك طارق ثم كتب إلى عبد الملك فأخبره ذلك وأخبره بشهادة جابر فقال عبد الملك صدق جابر فأمضى ذلك طارق فإن ذلك الحائط لبني المعمر حتى اليوم
