Saeed bin Musayab reported,

Any wound that pierces through one of the limbs carries one third of the blood money due for that limb.Malik related to me that Ibn Shihab did not hold this view, and Malik said, "I do not consider that there is any agreed upon ruling concerning a wound that pierces through one of the limbs of the body. Rather, I hold that it is a matter for considered judgment, and the ruler exercises his judgment in it. There is no ruling on this that is agreed upon among us."

وحدثني يحيى عن مالك، عن يحيى بن سعيد،

عن سعيد بن المسيب: أنه قال

كل نافذة في عضو من الأعضاء ففيها ثلث عقل ذلك العضو. حدثني مالك: كان ابن شهاب لا يرى ذلك، وأنا لا أرى في نافذة في عضو من الأعضاء في الجسد أمرا مجتمعا عليه، ولكني أرى فيها الاجتهاد، يجتهد الإمام في ذلك، وليس في ذلك أمر مجتمع عليه عندنا.
