The Messenger of Allah ﷺ ruled that for a fetus killed in its mother's womb the compensation was a slave, male or female.The man against whom the judgment was given protested, "How can I be made to pay compensation for one who neither drank nor ate, neither spoke nor cried out? A claim like that should be void."The Messenger of Allah ﷺ replied, "This man is one of the brethren of the soothsayers."
و حدثني عن مالك عن ابن شهاب
أن رسول الله ﷺ قضى في الجنين يقتل في بطن أمه بغرة عبد أو وليدة فقال الذي قضي عليه كيف أغرم ما لا شرب ولا أكل ولا نطق ولا استهل ومثل ذلك بطل فقال رسول الله ﷺ إنما هذا من إخوان الكهان
