Yahya reported,

Malik reported from Jamil bin Abdul-Rahman, the muezzin, that he used to attend the sessions of Umar bin Abdul-Aziz while he judged between the people. When a man came claiming that another man owed him something, Umar would look into the matter. If there had been dealings or some prior association between the two of them, he would have the one against whom the claim was made take an oath. But if nothing of that sort existed between them, he would not require him to swear.

قال مالك عن جميل بن عبد الرحمن المؤذن أنه كان يحضر عمر بن عبد العزيز وهو يقضي بين الناس فإذا جاءه الرجل يدعي على الرجل حقا نظر فإن كانت بينهما مخالطة أو ملابسة أحلف الذي ادعي عليه وإن لم يكن شيء من ذلك لم يحلفه
