Sulayman bin Yasar and others were asked about a man who had been flogged as a prescribed punishment, whether his testimony was acceptable. They said, "Yes, once his repentance has become evident."Malik told me that he heard Ibn Shihab being asked about this, and he gave the same answer as Sulayman bin Yasar.Malik said, "That is the position we hold, because of the words of Allah , 'And those who accuse chaste women and then do not produce four witnesses, flog them with eighty lashes and never accept their testimony thereafter, for they are the transgressors, except those who repent afterwards and put things right, for Allah is Forgiving and Merciful.'" عن سليمان بن يسار وغيره أنهم سئلوا عن رجل جلد الحد أتجوز شهادته فقالوا نعم إذا ظهرت منه التوبة و حدثني مالك أنه سمع ابن شهاب يسأل عن ذلك فقال مثل ما قال سليمان بن يسار قال مالك وذلك الأمر عندنا وذلك لقول الله تبارك وتعالى {والذين يرمون المحصنات ثم لم يأتوا بأربعة شهداء فاجلدوهم ثمانين جلدة ولا تقبلوا لهم شهادة أبدا وأولئك هم الفاسقون إلا الذين تابوا من بعد ذلك وأصلحوا فإن الله غفور رحيم}
