Abdullah bin Umar sold a slave boy of his for eight hundred dirhams, selling him with a disclaimer of liability for defects. The buyer then said to Abdullah bin Umar, "The boy has an illness that you did not disclose to me."So the two of them brought their dispute before Uthman bin Affan.The man said, "He sold me a slave who has an illness that he did not disclose."Abdullah said, "I sold him to him with a disclaimer of liability."Uthman bin Affan ruled that Abdullah bin Umar must swear an oath to him that he had sold him the slave without knowing of any illness in him. Abdullah refused to swear the oath and took the slave back. The slave then recovered while in his possession, and Abdullah later sold him for one thousand five hundred dirhams.
حدثني يحيى عن مالك عن يحيى بن سعيد
أن عبد الله بن عمر باع غلاما له بثمان مائة درهم وباعه بالبراءة فقال الذي ابتاعه لعبد الله بن عمر بالغلام داء لم تسمه لي فاختصما إلى عثمان بن عفان فقال الرجل باعني عبدا وبه داء لم يسمه وقال عبد الله بعته بالبراءة فقضى عثمان بن عفان على عبد الله بن عمر أن يحلف له لقد باعه العبد وما به داء يعلمه فأبى عبد الله أن يحلف وارتجع العبد فصح عنده فباعه عبد الله بعد ذلك بألف وخمس مائة درهم
