Muawiya bin Abu Ayyash Ansari reported that he was sitting with Abdullah bin Zubayr and Asim bin Umar bin Khattab when Muhammad bin Iyas bin Bukayr came to them and said, "A man from the desert people divorced his wife three times before consummating the marriage. What is your opinion on this?"Abdullah bin Zubayr replied, "This is a matter on which we have nothing to say. Go to Abdullah bin Abbas and Abu Hurairah, for I left them both with Ayesha. Ask them, then come back and tell us."So he went and asked them.Ibn Abbas said to Abu Hurairah, "Give him the ruling, Abu Hurairah, for a difficult case has come to you."Abu Hurairah said, "One pronouncement separates her from him, and three make her forbidden to him until she marries another husband."Ibn Abbas said the same.
و حدثني عن مالك عن يحيى بن سعيد
عن معاوية بن أبي عياش الأنصاري أنه كان جالسا مع عبد الله بن الزبير وعاصم بن عمر بن الخطاب قال فجاءهما محمد بن إياس بن البكير فقال إن رجلا من أهل البادية طلق امرأته ثلاثا قبل أن يدخل بها فماذا تريان فقال عبد الله بن الزبير إن هذا الأمر ما لنا فيه قول فاذهب إلى عبد الله بن عباس وأبي هريرة فإني تركتهما عند عائشة فسلهما ثم ائتنا فأخبرنا فذهب فسألهما فقال ابن عباس لأبي هريرة أفته يا أبا هريرة فقد جاءتك معضلة فقال أبو هريرة الواحدة تبينها والثلاثة تحرمها حتى تنكح زوجا غيره وقال ابن عباس مثل ذلك
