Tulayha Asadiyya was married to Rashid Thaqafi, and he divorced her. She then married again while still within her waiting period, so Umar bin Khattab whipped her and whipped her husband with a lash several times, and separated the two of them.Then Umar bin Khattab said, "Any woman who marries during her waiting period, if the husband who married her has not yet consummated the marriage with her, they are to be separated, and she completes the remainder of her waiting period from her first husband. After that the second man is simply one suitor among the suitors. But if he has consummated the marriage with her, they are to be separated, and she completes the remainder of her waiting period from the first husband, then observes a waiting period from the second, and the two of them may never come together again."
و حدثني عن مالك عن ابن شهاب
أن طليحة الأسدية كانت تحت رشيد الثقفي فطلقها فنكحت في عدتها فضربها عمر بن الخطاب وضرب زوجها بالمخفقة ضربات وفرق بينهما ثم قال عمر بن الخطاب أيما امرأة نكحت في عدتها فإن كان زوجها الذي تزوجها لم يدخل بها فرق بينهما ثم اعتدت بقية عدتها من زوجها الأول ثم كان الآخر خاطبا من الخطاب وإن كان دخل بها فرق بينهما ثم اعتدت بقية عدتها من الأول ثم اعتدت من الآخر ثم لا يجتمعان أبدا
