A man was brought before Numan bin Bashir who had slept with his wife's slave-girl. He said, "I will only judge in this case according to the ruling of the Messenger of Allah ﷺ. If she had permitted him to be with her, I will lash him one hundred times, and if she had not given him permission, I will stone him to death."
حدثنا حميد بن مسعدة حدثنا خالد بن الحارث حدثنا سعيد عن قتادة
أتي النعمان بن بشير برجل غشي جارية امرأته فقال لا أقضي فيها إلا بقضاء رسول الله ﷺ قال إن كانت أحلتها له جلدته مائة وإن لم تكن أذنت له رجمته
[Hasan] Tirmidhi related it, in Hudud, chapter on what has been said about a man who has intercourse with his wife's slave girl, hadith 1451, from the hadith of Saeed bin Abu Aruba with this wording, and Ayub bin Miskeen corroborated him there.Qatada did not hear from Habib bin Salim, rather he heard it from Khalid bin Arfata, and Habib wrote it to him. Abu Bishr corroborated him, narrating from Khalid bin Arfata from... etc. Abu Hatim and Bazzar considered Khalid unknown, while Ibn Hibban considered him reliable. The following hadith serves as a corroborating witness for it.
