The Messenger of Allah ﷺ established the right of pre-emption only in property that has not yet been divided. Once the boundaries have been set and the roads marked out, there is no pre-emption.
حدثنا محمد بن يحيى حدثنا عبد الرزاق عن معمر عن الزهري عن أبي سلمة
إنما جعل رسول الله ﷺ الشفعة في كل ما لم يقسم فإذا وقعت الحدود وصرفت الطرق فلا شفعة
Bukhari narrated it in the Book of Sales, chapter on a partner selling to his partner, hadith no. 2213, 2214, from the hadith of Abdul-Razzaq, with this wording.
