The Messenger of Allah ﷺ ruled that the right of preemption applies to property that has not been divided, but once the boundaries have been set, there is no right of preemption.Muhammad bin Hammad Tahrani related to us, saying, Abu Asim related to us from Malik, from Zuhri, from Saeed bin Musayab and Abu Salama, from Abu Hurairah, from the Prophet ﷺ, something similar.Abu Asim said, the report through Saeed bin Musayab is interrupted, while the one from Abu Salama, from Abu Hurairah, has a connected chain.
[Sahih] Bayhaqi narrated it, 6/103, 104, and others narrated it through various routes from Malik with this wording. Habban graded it sahih in Mawarid, no. 1152, as did Busiri. A group of narrators transmitted it from Malik with the chain missing a link, and no. 2499 serves as a corroborating witness for it.
