Two men brought a dispute before the Messenger of Allah ﷺ over an animal, with neither of them having any evidence. He divided it equally between them.
حدثنا إسحق بن منصور ومحمد بن معمر وزهير بن محمد قالوا حدثنا روح بن عبادة حدثنا سعيد عن قتادة عن سعيد بن أبي بردة عن أبيه
أن رسول الله ﷺ اختصم إليه رجلان بينهما دابة وليس لواحد منهما بينة فجعلها بينهما نصفين
Sourcing, hasan. Abu Dawud reported it in the Book of Judgments, Chapter on Two Men Who Both Claim Something Without Any Evidence Between Them, hadith no. 3613, from the hadith of Qatada with this wording. Shayba narrated it from Qatada with this wording in Sunan al-Kubra by Bayhaqi, 10/257, and in the printed Musnad of Imam Ahmad, 4/402, and it has very many corroborating narrations.
