There was a dispute between me and a Jewish man over a piece of land, and he denied my claim to it. So I brought him before the Prophet ﷺ.The Messenger of Allah ﷺ asked me, "Do you have any evidence?"I replied, "No."He then said to the Jew, "Take an oath."I said, "If he does, he will swear falsely and take away my property."So Allah, glorified is He, revealed, "Indeed, those who exchange the covenant of Allah and their own oaths for a small price..." [Aal Imran 3:77] to the end of the verse.
حدثنا محمد بن عبد الله بن نمير وعلي بن محمد قالا حدثنا وكيع وأبو معاوية قالا حدثنا الأعمش عن شقيق
كان بيني وبين رجل من اليهود أرض فجحدني فقدمته إلى النبي ﷺ فقال لي رسول الله ﷺ هل لك بينة قلت لا قال لليهودي احلف قلت إذا يحلف فيه فيذهب بمالي فأنزل الله سبحانه {إن الذين يشترون بعهد الله وأيمانهم ثمنا قليلا} إلخ الآية
Bukhari recorded it in the book of sharecropping and irrigation (Musaqah), in the chapter on disputes over a well and rulings concerning it, and Muslim recorded it in the book of faith (Iman), in the chapter on the warning against one who seizes another's right by a false oath, etc. Both narrated it from the hadith of Amash, h: 2356, 2357 (Bukhari) and h: 138 (Muslim), narrated by "with the fire," through Ibn Numayr.
