Ibn Majah 2074

Sourcing, [its chain of transmission is daif]. Abu Dawud narrated it in the Book of Divorce, chapter of one who said he was free, hadith no. 2235. Tirmidhi, Nasai, and Ibn Majah also narrated it from the hadith of Ibrahim with the same wording, and Tirmidhi said, hasan sahih.I say, Ibrahim Nakhai was known to obscure his sources, as Hakim and others have said, and I did not find any explicit statement that he heard it directly.Ibn Hibban mentioned this hadith in his Sahih (al-Ihsan), hadith no. 4257, but he said, "Aswad was mistaken in his statement that he was free." Even if this hadith were established as coming from Aswad, it would still be daif, because it contradicts a large group of narrators, and a large number is more reliable in memorization than a single individual.Note, his statement "and she had a free husband" is from the words of Aswad, may Allah have mercy on him, as found in the narration of Abu Awana from Mansur, in Bukhari and others.
