The Messenger of Allah ﷺ said, "A previously married woman has more right over herself than her guardian, and a virgin is to be consulted regarding herself."Someone asked, "Messenger of Allah, a virgin would be too shy to speak."He replied, "Her silence is her consent."
حدثني إسمعيل بن موسى السدي حدثنا مالك بن أنس عن عبد الله بن الفضل الهاشمي عن نافع بن جبير بن مطعم
قال رسول الله ﷺ الأيم أولى بنفسها من وليها والبكر تستأمر في نفسها قيل يا رسول الله إن البكر تستحيي أن تتكلم قال إذنها سكوتها
Muslim narrated it in the Book of Marriage, chapter on seeking the consent of the previously married woman by speech and the virgin by silence, hadith no. 1421, from the hadith of Malik, through this same chain.
