The Prophet ﷺ established the right of pre-emption only in property that has not yet been divided. Once the boundaries have been set and the roads marked out, there is no right of pre-emption.Some people have said that pre-emption applies to a neighbor, then they proceeded to undermine what they had affirmed and nullified it. They said that if a man buys a house and fears that his neighbor will claim it through pre-emption, he may first purchase one share out of a hundred and then purchase the remainder. The neighbor would have the right of pre-emption only in the first share, but no right of pre-emption in the rest of the house, and he is permitted to use such a stratagem.
حدثنا عبد الله بن محمد حدثنا هشام بن يوسف أخبرنا معمر عن الزهري عن أبي سلمة
إنما جعل النبي ﷺ الشفعة في كل ما لم يقسم فإذا وقعت الحدود وصرفت الطرق فلا شفعة وقال بعض الناس الشفعة للجوار ثم عمد إلى ما شدده فأبطله وقال إن اشترى دارا فخاف أن يأخذ الجار بالشفعة فاشترى سهما من مائة سهم ثم اشترى الباقي وكان للجار الشفعة في السهم الأول ولا شفعة له في باقي الدار وله أن يحتال في ذلك
