The Prophet ﷺ said, "A virgin is not to be married off until her permission is sought, nor a previously married woman until her consent is requested."Someone asked, "Messenger of Allah, how is her permission given?"He replied, "By her remaining silent."Some people have said, If a virgin's permission is not sought and she is not given in marriage, and a man then resorts to a trick by producing two false witnesses who testify that he married her with her consent, and the judge confirms the marriage, then there is no harm in the husband having intercourse with her, even though he knows the testimony is false, and the marriage is valid.

عن النبي ﷺ قال لا تنكح البكر حتى تستأذن ولا الثيب حتى تستأمر فقيل يا رسول الله كيف إذنها قال إذا سكتت وقال بعض الناس إن لم تستأذن البكر ولم تزوج فاحتال رجل فأقام شاهدي زور أنه تزوجها برضاها فأثبت القاضي نكاحها والزوج يعلم أن الشهادة باطلة فلا بأس أن يطأها وهو تزويج صحيح
