A slave belonging to the state's servants had intercourse with a slave girl from the fifth share, forcing her against her will until he took her virginity. Umar had him flogged with the prescribed punishment and banished him, but he did not flog the girl, because she had been forced.Zuhri said concerning a virgin slave girl whose virginity is taken by a free man, the ruler shall assess compensation for the virgin slave girl according to her value, and the man is to be flogged. In the case of a slave girl who is not a virgin, according to the judgments of the leaders there is no compensation, but the prescribed punishment is due from him.
وقال الليث حدثني نافع، أن
أن عبدا من رقيق الإمارة وقع على وليدة من الخمس، فاستكرهها حتى افتضها، فجلده عمر الحد ونفاه، ولم يجلد الوليدة من أجل أنه استكرهها. قال الزهري في الأمة البكر، يفترعها الحر، يقيم ذلك الحكم من الأمة العذراء بقدر قيمتها، ويجلد، وليس في الأمة الثيب في قضاء الأئمة غرم، ولكن عليه الحد.
