Mujahid commented on the verse "And those of you who die and leave behind wives" [Baqarah 2:234], saying that a widow was formerly required to observe this waiting period in the home of her husband's family. Then Allah revealed "And those of you who die and leave behind wives should bequeath for their wives a year's maintenance without turning them out, but if they leave of their own accord, there is no blame on you for what they do with themselves in a lawful manner" [Baqarah 2:240].Mujahid explained, "Allah granted her a bequest completing the full year, seven months and twenty nights. If she wished, she could remain in the home covered by that bequest, and if she wished, she could leave. That is the meaning of Allah's words "without turning them out, but if they leave of their own accord, there is no blame on you" [Baqarah 2:240]. Yet the waiting period itself remained obligatory upon her as before." This is what was reported from Mujahid.Ata said that Ibn Abbas held that this verse abrogated the requirement that she observe her waiting period in her husband's family's home, so she may now observe it wherever she wishes, as indicated by Allah's words "without turning them out" [Baqarah 2:240].Ata added, "If she wishes, she may observe the waiting period with her husband's family and remain in the home covered by the bequest, and if she wishes, she may leave, because of Allah's words "there is no blame on you for what they do with themselves" [Baqarah 2:240]."Ata further said, "Then the law of inheritance came and abrogated the provision of lodging, so she may observe her waiting period wherever she wishes, and she has no right to lodging."
حدثني إسحاق بن منصور أخبرنا روح بن عبادة حدثنا شبل
عن مجاهد {والذين يتوفون منكم ويذرون أزواجا} قال كانت هذه العدة تعتد عند أهل زوجها واجبا فأنزل الله {والذين يتوفون منكم ويذرون أزواجا وصية لأزواجهم متاعا إلى الحول غير إخراج فإن خرجن فلا جناح عليكم فيما فعلن في أنفسهن من معروف} قال جعل الله لها تمام السنة سبعة أشهر وعشرين ليلة وصية إن شاءت سكنت في وصيتها وإن شاءت خرجت وهو قول الله تعالى {غير إخراج فإن خرجن فلا جناح عليكم} فالعدة كما هي واجب عليها زعم ذلك عن مجاهد وقال عطاء قال ابن عباس نسخت هذه الآية عدتها عند أهلها فتعتد حيث شاءت وقول الله تعالى {غير إخراج} وقال عطاء إن شاءت اعتدت عند أهلها وسكنت في وصيتها وإن شاءت خرجت لقول الله {فلا جناح عليكم فيما فعلن في أنفسهن} قال عطاء ثم جاء الميراث فنسخ السكنى فتعتد حيث شاءت ولا سكنى لها
