Urwah reported that he asked Ayesha , addressing her, "Mother, tell me about the verse 'And if you fear that you will not deal justly with the orphan girls', up to His words 'what your right hands possess'" [Nisa 4:3].Ayesha replied, "Son of my sister, this refers to an orphan girl under the care of her guardian, who is attracted by her beauty and her wealth and wants to give her less than her proper bridal gift. So they were forbidden to marry such girls unless they dealt justly with them by paying the bridal gift in full, and they were commanded to marry other women instead."Ayesha continued, "Later on people asked the Messenger of Allah ﷺ for a ruling, and Allah revealed 'And they ask you for a ruling concerning women', up to His words 'while you desire to marry them' [Nisa 4:127]. So Allah
made clear to them in this verse that when an orphan girl had wealth and beauty, they were eager to marry her, desiring her lineage and the bridal gift, but when she had little wealth or beauty and held no attraction for them, they left her and took other women instead."She said, "Just as they leave her when they have no desire for her, they have no right to marry her when they do desire her unless they deal justly with her and give her the full bridal gift that is her due."
حدثنا أبو اليمان أخبرنا شعيب عن الزهري وقال الليث حدثني عقيل عن ابن شهاب أخبرني
أنه سأل عائشة رضي الله عنها قال لها يا أمتاه {وإن خفتم ألا تقسطوا في اليتامى} إلى قوله {ما ملكت أيمانكم} قالت عائشة يا ابن أختي هذه اليتيمة تكون في حجر وليها فيرغب في جمالها ومالها ويريد أن ينتقص من صداقها فنهوا عن نكاحهن إلا أن يقسطوا لهن في إكمال الصداق وأمروا بنكاح من سواهن من النساء قالت عائشة استفتى الناس رسول الله ﷺ بعد ذلك فأنزل الله {ويستفتونك في النساء} إلى قوله {وترغبون أن تنكحوهن} فأنزل الله عز وجل لهم في هذه الآية أن اليتيمة إذا كانت ذات مال وجمال رغبوا في نكاحها ونسبها والصداق وإذا كانت مرغوبا عنها في قلة المال والجمال تركوها وأخذوا غيرها من النساء قالت فكما يتركونها حين يرغبون عنها فليس لهم أن ينكحوها إذا رغبوا فيها إلا أن يقسطوا لها ويعطوها حقها الأوفى من الصداق
