The Prophet ﷺ ruled that the right of pre-emption applies to every property that has not been divided. Once the boundaries have been set and the roads laid out, there is no pre-emption.

قضى النبي ﷺ بالشفعة في كل ما لم يقسم فإذا وقعت الحدود وصرفت الطرق فلا شفعة
