Umar, may Allah be pleased with him, sent Hamza out as a collector of zakat. A man had intercourse with the slave-girl of his wife, so Hamza took a guarantor from the man until he could bring him before Umar. Umar had previously flogged such a man with a hundred lashes, but he accepted their truthful account and excused him on grounds of ignorance.Jareer and Ashath said to Abdullah bin Masud regarding apostates, "Call on them to repent and require guarantors for them." So they repented, and their clans stood as guarantors for them.Hammad said, "If someone stands as guarantor for a person and that person dies, no liability falls upon the guarantor."Hakam said, "He is liable."
وقال أبو الزناد
أن عمر رضى الله عنه بعثه مصدقا، فوقع رجل على جارية امرأته، فأخذ حمزة من الرجل كفيلا حتى قدم على عمر، وكان عمر قد جلده مائة جلدة، فصدقهم، وعذره بالجهالة. وقال جرير والأشعث لعبد الله بن مسعود في المرتدين استتبهم، وكفلهم. فتابوا وكفلهم عشائرهم. وقال حماد إذا تكفل بنفس فمات فلا شىء عليه. وقال الحكم يضمن.
