I was standing with Saad bin Abu Waqqas when Miswar bin Makhrama came and placed his hand on one of my shoulders. Just then Abu Rafi, the freedman of the Prophet ﷺ, arrived and said, "Saad, buy from me my two houses that are within your property."Saad replied, "By Allah, I will not buy them."Miswar said, "By Allah, you shall buy them."Saad said, "By Allah, I will not pay you more than four thousand, in installments or by portions."Abu Rafi said, "I have been offered five hundred dinars for them, and had I not heard the Prophet ﷺ say, 'A neighbor has the greatest right to what is adjacent to him,' I would not have sold them to you for four thousand when I am being offered five hundred dinars for them."So he gave them over to him.
Bukhari reported the hadith of Ibrahim bin Maysara from Amr bin Shareed from Abu Rafi, "The neighbor has more right to preemption due to proximity," through the narration of Thawri, Ibn Jurayj, and Ibn Uyayna, and this is the correct view. No attention should be paid to the statement of Muhammad bin Muslim from Ibrahim bin Maysara, nor to anyone who disagreed with it.
The Hafiz said in the Introduction, p. 360, after the statement of Daraqutni, "Muhammad bin Muslim differed from them, narrating from Ibrahim bin Maysara, but no attention should be paid to him," meaning because he is daif, so his narration does not cast doubt on the established narrations. End of quote.I say, Muhammad bin Muslim is Taifi. The Hafiz said in Taqrib, "Truthful, but makes mistakes, from the eighth generation." End of quote.
