The Messenger of Allah ﷺ established the right of pre-emption in every property that has not yet been divided. Once the boundaries have been set and the roads marked out, there is no pre-emption.

جعل رسول الله ﷺ الشفعة في كل مال لم يقسم فإذا وقعت الحدود وصرفت الطرق فلا شفعة
